Is NobleWills Online Will Suitable For Me?
3 min read
NobleWills’ Online Will service for Malaysia is designed for individuals living in Malaysia who wish to make straightforward distributions of their estate in a clear and structured manner.
To determine whether our online Will service is suitable for you, please consider the following situations.
Our Online Will Services
Our online Will platform is designed for individuals with straightforward estate-planning needs. Unlike generic templates, every Will created on our platform is reviewed by a Will specialist to ensure it meets legal requirements. If we identify any issues, we will contact you by email. The online service is available in two tiers:
- Basic Online Will
- Advanced Online Will (includes confirmation of your identity, a video consultation, professional printing of your Will, and the option to add country-specific Wills)
The sections below will help you determine which option may be suitable for your circumstances.
1. Where Are You Domiciled?
In general terms, domicile refers to the country you regard as your long-term home and with which you have a substantial connection.
- If you are domiciled in Malaysia, either our Basic or Advanced Online Will service may be suitable.
- If you are domiciled outside Malaysia, we recommend choosing our Advanced Online Will service so that your situation can be reviewed more carefully.
2. You Want Your Will to Cover Malaysian Assets Only
Our Basic Online Will service is designed primarily to cover Malaysian assets. It will also extend to assets in other jurisdictions that recognize foreign Wills, and it will revoke any prior Wills you have made, including those written in another country.
If you hold assets in multiple countries but intend for your Malaysian Will to deal with Malaysian assets only, our Advanced Online Will may be appropriate. This includes a video consultation during which we can discuss how to structure your Will to avoid unintentionally affecting your overseas estate planning.
We are continuously expanding our platform to include jurisdiction-specific Wills, and additional options will be introduced over time. If you currently hold assets overseas and require a country-specific Will, you may contact us directly and we will advise whether we are able to assist for that jurisdiction.
3. You Have an Existing Will
- If you have an existing Will and intend to revoke it and replace it, you may use our online Will service. The Will prepared through NobleWills will then become your new Will, and you should ensure the previous Will is properly destroyed.
- If you have an existing Will made in another jurisdiction and do not wish to revoke it, our Advanced Online Will allows us to tailor your Malaysian Will so that it does not revoke your overseas Will.
4. You Have a More Complex Estate
Our online Will platform is designed for straightforward estate distributions.
If your situation involves:
- Complex asset structures
- Multiple layers of distribution
- Significant overseas assets
our online services may not be suitable. In such cases, we recommend our Premium Will Service, where you can discuss your circumstances directly with our Will specialists.
5. Health and Capacity Considerations
If you are:
- Terminally ill, or
- Suffering from serious mental or physical conditions
we strongly recommend that you contact a medical practitioner before signing your Will.
If you are unable to sign a Will using a pen, our service would not be suitable for you.
6. Muslim Clients (Sharia Considerations)
For individuals of a Muslim background, Islamic inheritance rules apply. Under Sharia principles, only up to one-third of the estate may be freely distributed through a Will, with the remainder governed by Faraid.
NobleWills currently does not offer Sharia-compliant Wills. If this applies to you, we recommend consulting a solicitor or professional experienced in Islamic estate planning.
Choosing the right Will-writing service helps ensure your wishes are clear, legally effective, and easier for your loved ones to carry out. If you are unsure which option is suitable, our team is happy to guide you.
Frequently Asked Questions (FAQs)
What is the difference between the Basic and Advanced Online Will?
The Advanced Online Will includes a video consultation to discuss your estate planning needs, confirm your identity, answer questions, provide a professional print of your Will, and allow minor adjustments to suit your personal circumstances. It also offers the option to add country-specific Wills.
Can I use NobleWills if I am not domiciled in Malaysia?
Yes, but you will need to use the Advanced Online Will or Premium service so your situation can be reviewed more carefully.
Can my Malaysian Will coexist with an overseas Will?
Yes. With proper structuring, a Malaysian Will can be drafted so that it does not revoke a Will made in another jurisdiction. Our Advanced Online Will service is recommended for this purpose.
When should I choose the Premium Will service?
You should choose the Premium service if you have a complex estate, citizenship issues, or require bespoke estate planning advice.
